Consolidated Complaint Filed in SDNY
A class action lawsuit tied to Pump.fun expanded in July 2025 after Wolf Popper LLP and Burwick Law filed a consolidated amended complaint in the United States District Court for the Southern District of New York.
In a case update dated July 30, 2025, the firms said the July 22 filing consolidated two matters: Carnahan v. Baton Corporation Ltd. d/b/a Pump.Fun et al. (No. 1:25-cv-00490), which the firms describe as the PNUT token case, and Aguilar v. Baton Corporation Ltd. d/b/a Pump.Fun et al. (No. 1:25-cv-00880). The consolidated case proceeds under the Aguilar caption.
The firms said Judge Colleen McMahon ordered consolidation on June 25, 2025, and Michael Okafor was appointed as lead plaintiff.
RICO and Consumer Claims Added
Wolf Popper and Burwick said the amended complaint adds claims under the Racketeer Influenced and Corrupt Organizations Act. The filing also adds claims under New York General Business Law Sections 349 and 350, plus unjust enrichment, according to the firms’ summary.
The plaintiffs characterize Pump.fun’s operations as a coordinated enterprise and describe the platform as simulating an “illegal digital casino” tied to meme coin creation and trading, according to the case update citing Law360.
Defendant List Expands Beyond Pump.fun
The consolidated amended complaint names additional defendants across the Solana ecosystem, according to the firms.
The new defendants listed in the update include Solana Labs, Inc. and co founders Anatoly Yakovenko and Raj Gokal, the Solana Foundation and executives Dan Albert, Lily Liu, and Austin Federa, Jito Labs and leadership Lucas Bruder and Brian Smith, plus the Jito Foundation.
Relief Sought
The firms said the plaintiffs are seeking class certification and compensatory damages. The filing also seeks treble damages tied to the RICO claims, rescission of Pump.fun token transactions, appointment of a federal equity receiver, and permanent injunctions aimed at preventing operation of similar platforms without required licenses and compliance controls.
